More than 7000 lawyers call for harsh measures on candidates

TEHRAN, May 13 (MNA) – 7456 law experts has sent a letter to Guardian Council members and called the Council for disqualifying what they believed to be ‘conspirators.’

The letter by law experts addressed Ayatollah Ahmad Jannati and Guardian Council’s other members. It indicated the group’s ‘complete’ support for the Council’s legal actions, and called it to disqualify active individuals in past years, especially in 2009 post-election unrests, for deviations from the ‘direct path of the Revolution’ without considerations of name and title.

The full text of experts, signed by 7456 law experts of the country (the list is not exhaustive) reads as the following:

In the Name of God, the Compassionate, the Merciful,

Verily! Allah commands that you should render back the trusts to those, to whom they are due; and that when you judge between men, you judge with justice. Verily, how excellent is the teaching which He (Allah) gives you! Truly, Allah is Ever All-Hearer, All-Seer (Quran. 4:58).

The sacred Islamic Republic system has origins in Islamic sacred Sharia, and has been shaped by the prophetic leadership of Imam Khomeini (RA), and has been based on the votes of large multitudes of the people, and has solidified by the sagacious leadership of the Supreme Leader of the Revolution. It is a constitutional system, all branches of which rely on mandatory regulations of state and charismatic leader, and the legitimacy of all its magistrates, and all their conducts originate in their abiding by the implementing the constitution, mandated by the laws, the system’s guiding principles, and other obligatory regulations.

The presidency in the Islamic Republic of Iran is considered an aspect of charismatic leader’s influence, and is the head of one of three branches of the system. In the Islamic political system, the absolute Imam and charismatic leader is incumbent on this position, and thus, it is required that an individual surrogating him, should be qualified according to necessary specifics. This fact has been enshrined in Article 115 under ‘President of the Islamic Republic’s characteristics,’ and in Article 121 in ‘President’s taking oath, based on which the president should have the following characteristics:

The President must be elected from among religious and political personalities possessing the following qualifications: Iranian origin; Iranian nationality; administrative capacity and resourcefulness; a good past-record; trustworthiness and piety; convinced belief in the fundamental principles of the Islamic Republic of Iran and the official madhhab of the country.

And,

The president will guard the official religion of the country, the order of the Islamic Republic and the Constitution of the country; will devote all his capacities and abilities to the fulfillment of the responsibilities that he has assumed; will dedicate himself to the service of the people, the honor of the country, the propagation of religion and morality, and the support of truth and justice, refraining from every kind of arbitrary behavior; will protect the freedom and dignity of all citizens and the rights that the Constitution has accorded the people; that in guarding the frontiers and the political, economic, and cultural independence of the country.

Now, that the deadline for registering for presidential elections has ended, and according to Section 9, Article 110 of the constitution, the Guardian Council should acquire the above-mentioned qualifications in the candidates. The signatories to this letter, the majority of whom are legal experts, university lecturers, judges, lawyers, legal advisors, and law graduates, announce their ‘complete’ support for the Council’s legal actions, and called it to disqualify active individuals in past years, especially in 2009 post-election unrests, for deviations from the ‘direct path of the Revolution’ without considerations of name and title, and show respect to the statement by Imam Khomeini that said “ whether I be alive or not, I recommend you that do not allow Revolution [achievements]fall to the hands of the strangers,” and act according to the maximum of courage and honesty, and set as their guideline this statement by Imam that said “ the Guardian Council should consider no one, except for God.”
