Majzooban Noor - According to the latest reports from Beydokht town, a court hearing date has been set for 92/07/20 (Oct 12, 2013) in order to handle an objection from Dervish lawyers against "Executive committee of Imam"s claim ownership of some items of Beydokht property. In the notification, it has been announced that : "With regard to Ruling of seizure, mentioned property has been seized, so it is appropriated to refer to the organization within 10 days, with legal documents which are used to prove ownership of property. Otherwise some legal action will take place." In 1364, the data shows that the claims had been fully resolved through Branch 32 of the Supreme Court under a special Judge elected by head of the Judiciary and the final decisions have been issued. In addition, Mr. Reza Ali Shah's death will also void any claim, because starting a court case against deceased person is not based on law. But, contrary to Principles and rules(!) "Executive committee of Imam" has attempted to confiscate the property of His holiness, Reza Ali Shah and also by just advertising in a low-circulation newspaper, "Hemayat" is trying to issues forceful ruling in absentia by the Mashhad Revolutionary Court successor of the Court Article 49, regarding the confiscation of 10 counts of the assets and properties in Beydokht. It is worth mentioning that, in accordance with Article 49 of the Iranian Constitution, The government has the responsibility of confiscating all wealth accumulated through usury, usurpation, bribery, embezzlement, theft, gambling, misuse of endowments, misuse of government contracts and transactions, the sale of uncultivated lands and other resources subject to public ownership, the operation of centers of corruption, and other illicit means and sources, and restoring it to its legitimate owner; and if no such owner can be identified, it must be entrusted to the public treasury. This rule must be executed by the government with due care, after investigation and furnishing necessary evidence in accordance with the law of Islam. Whereas Mr. Reza Ali Shah inherited mentioned properties which is not covered by Article 49 of the constitution, so it is obvious that he is the absolute owner.
